A mother tearfully denounces the actions of justice institutions that have released from prison the person who fatally injured her only son, who was born after 6 sisters.

Pashame Muçaj tells the investigative show Fiks Fare that the actions of the police, prosecution, and court were inadequate in the accident of February 17, 2025, where her son Gëzim Muçaj lost his life near Qafë e Kasharit, on the Tirana – Durrës highway.

After many days in a coma, Ervin Qiro also died in hospital. Shkëlqim Doçi was seriously injured in the accident, and to this day, he has serious health problems. He spent about 40 days in a coma and then another 18 days in the ward after waking up from a coma. The fourth person who was hit is Eduart Pipa, who suffered major fractures in his leg. Meanwhile, the perpetrator of the accident, Ismail Laçe, was released after 72 hours by the Tirana Court, as he was “69 years old, retired, with high blood pressure and had a sick wife”. He has been investigated and is now being tried under the security measure of “house arrest”.

“My 27-year-old son was in an accident and the person who ran him over is inside the house and my son is rotting on the ground. I don’t know who took him out without giving him any kind of justice, because I can also judge myself. That day the son ran away to pick up the workers and his steering wheel got stuck on the road. Then the other one came speeding and drunk. There were 4 people, 2 dead and 2 injured. My son died on the spot. There was also another victim from the accident, the son’s friend,” says Pashame Muçaj.

According to her, the perpetrator is Ismail Laçe, who was in another vehicle. “He was speeding and killed her. They didn’t notify me about the investigation, only when they brought me a letter and I went to court and they told me that the perpetrator is at home without giving any statement. The perpetrator had been released and was under house arrest. They held him for 72 hours and then released him and we don’t know what he looks like. We haven’t even signed anything to forgive him, no statement,” the elderly woman adds.

Then she tells the fateful day, when her son, who had come into the world after 6 sisters, lost his life. “The incident happened at a quarter to 5, just when I got a call. I went to the Military Hospital and found him dead. He was the brother of 6 sisters, the only son. His father is sick, only he and I are left, we live on minimal pensions. He supported us, there was no one to support us. His mother had him,” says the old woman and then starts to cry. “I only ask for justice and for him to stay at home and for my son to rot. I ask for justice, not just to do justice. He was released for 3 days, no one notified me. We knew he was in prison and not under house arrest,” she concludes.

Fiksi also spoke with the victim’s sister, Flutura Muçaj, who says her brother died at the scene. “He had a blow to the head. We haven’t had any information from the investigations. I went to the prosecutor’s office and they told me the investigations weren’t over. Now a letter came to our house. They always told me the perpetrator was in prison. When we had the trial on June 2, we went and learned that the perpetrator had been released. He had only spent 3 days in prison,” she says.

According to her, the investigation revealed that the perpetrator was guilty, as he had consumed alcohol and was driving at high speed. “Having 2 dead and 2 injured and staying at home is absurd. The incident happened in front of the license plates, on the Tirana – Durrës highway. I went to the Traffic Police and nothing was given to us. The footage told me that they had handed them over to the prosecutor’s office. Even the personal belongings were handed over to another person. I found them one by one, I found half of them, half of them are gone,” she adds.

In the end, there is only one demand. “We demand justice, we don’t owe anyone anything. If the state doesn’t do justice, we will do it ourselves. If you build a wall without a permit, you spend 3 years in prison, if you kill 4 people, you stay home,” Flutura concludes.

Eduart stated that they were traveling towards Palasa in Himara, where they worked at a construction company, when near Qafë e Kasharit, their vehicle went off the road, as a result of construction work on the Tirana – Durrës highway. Then, a Benz vehicle, driven by the perpetrator Ismail Laçe, sped away, hitting all four of them. The file states that the perpetrator was breathalyzed and tested “under the influence of alcohol.”

On February 19, 2025, Laçe appeared before the Tirana Court, where he was surprisingly ordered to be placed under house arrest. The court accepted the lawyers’ arguments that he is elderly, unconvicted, married, head of household, father of one child, 70 years old, retired, with high blood pressure and his wife is ill.

After more than 1 year under investigation, the file has been sent to court. The file clearly shows that the perpetrator, Ismail Laçe, had consumed alcohol at a level of 0.20 mg/l. As a precautionary measure, the court writes that it cannot consider him “under the influence of alcohol”, as he should have drunk more!

Expertise has been conducted, which resulted in the vehicle’s speed being 90 km per hour, while in one case they write that the speed could have been between 80 and 100 km per hour, i.e. above the allowed limit. The allowed speed in that segment was only 40 km per hour.

In the end, the auto-technical experts have determined that “the violations of citizen Ismail Laçe constitute the determining technical cause of this accident.” But, in addition to the numerous violations that caused 4 victims, 2 dead and 2 seriously injured, the perpetrator was again investigated and is being tried acquitted!/Topchannel
