The Constitutional Court has partially accepted the request of the leader of the Democratic Party, Sali Berisha, regarding the security measure “obligation to appear”.
According to the reasoning provided by the Constitutional Court, the security measure “Obligation to report to the Judicial Police” interferes with the freedom of movement, guaranteed by Article 38 of the Constitution.
The court assessed that the Supreme Court had not responded to the claims related to the need and appropriateness of this security measure.
For this reason, the case will be returned to the Supreme Court, which must reexamine the issues identified by the Constitutional Court.
The Constitutional Court’s decision does not automatically lift the security measure against Sali Berisha. It annuls the Supreme Court’s decision and returns the case for reconsideration.
Consequently, the Supreme Court must re-examine the case, taking into account the Constitutional Court’s observations on the justification of the necessity and appropriateness of the measure.
