Cristiano Mossali’s responsibility for the murder of Albanian Nexhat Rama is considered certain, while what remains to be determined is whether the crime was premeditated, as the Prosecution has claimed all along, or not.
This is the fundamental change that is expected to determine the final sentence of the 56-year-old from Capriolo, after the decision has been appealed. In the first instance, the Serious Crimes Court sentenced Mossali to 27 years in prison, while the Court of Appeal reduced the sentence to 14 years, assessing that premeditation had not been sufficiently proven.
Mossali, a car mechanic from Capriolo, has been in prison since early September, four years ago. He is accused of murdering Nexhat Rama in his auto repair shop and then burning the victim’s body and car in a rural area not far from his home.
Now, the 56-year-old will have to wait the coming months to learn how long he will have to stay in prison and whether the final sentence will be the one imposed by the Court of Appeals or whether the more severe first-instance sentence will be reinstated.
At the heart of the case remains the question of whether Mossali had planned the murder in advance or whether it was a crime without premeditation. A determination that brings a considerable difference in the sentence: from 27 years in prison in the first instance, to 14 years according to the Appeals decision.
