The Head of the Special Prosecution Office (SPAK), Klodian Braho, has avoided a direct response regarding further legal steps that will be taken regarding the file of former Deputy Prime Minister Belinda Balluku, after the addition of new charges against her.
During his report to the Laws Committee, asked whether SPAK will address the Assembly again with a new request for her arrest, Braho refused to announce the decision-making.
The head of SPAK has guaranteed that every decision of the structure he leads will be strictly based on the law and the evidence obtained from the investigation, adding that the reasons for the rejection of the first request by parliament will also be taken into account.
Braho further emphasized that SPAK’s position on this issue is now public and that the prosecution has continued its work without being affected by the Assembly’s decision not to lift immunity. According to him, these elements do not at all violate the integrity and credibility of the institution in handling high-profile files, as the facts show that the investigations are being conducted in a complete and independent manner.
During the discussions in the committee, the head of SPAK also focused on the problems that parliamentary immunity brings to the work of investigators, stating that the prohibition of imposing security measures makes it difficult and in some cases even damages a certain investigation.
“I can tell you two things, you have clear SPAK’s position as well as the way SPAK has continued the investigations without any rejection of the request. The facts show that SPAK has done its job. These elements do not create conviction or doubt about SPAK’s integrity in a high-profile case. I cannot pre-announce decision-making on the cases under investigation. What I guarantee is that it will be a decision-making guaranteed by law, on the evidence provided by the investigation, taking into account the reasons why the parliament decided to reject the request,” he said.
